Chaturbate Agrees to Pay Substantial Fine for Non-Compliance with Texas Age Verification Law

In a recent development, the adult website Chaturbate has reached a settlement agreement with the Texas Attorney General’s office, agreeing to pay a substantial fine of $675,000 for failing to adhere to the state’s age verification law for online pornographic content. This information comes from a report by 404 Media, citing a court order released on Friday.

Texas enacted a law, known as HB 1181, in 2022, which mandates that all adult websites operating within the state must implement measures to verify the age of their users through government-issued identification documents such as driver’s licenses or passports. Failure to comply with this law can result in significant fines, up to $20,000 per day, with an additional penalty of $250,000 if minors are found to have accessed the site.

Last month, the Texas Attorney General, Ken Paxton, filed lawsuits against Chaturbate and Pornhub for disregarding the age verification requirement. While Chaturbate has since implemented an age verification system through a company called Incode, which also handles identity verification and fraud detection for mainstream banking clients, other prominent adult websites like Pornhub and XHamster have opted to block access to their entire platforms within the state of Texas.

Initially, Texas sought a fine of $1.78 million from Chaturbate, calculated based on the 178 days the company remained non-compliant after the law came into effect on September 1, 2023. However, the final settlement amount was reduced to $675,000, which Chaturbate is required to pay within 30 days.

Attorney General Paxton expressed satisfaction with Chaturbate’s decision to implement age verification measures, stating, “It’s a very positive development that this company has decided to follow the law and begin reasonable age verification measures designed to protect Texas children from harmful material. Other pornography companies should follow this example and willingly choose to do the right thing and abide by the law.”

Apart from Texas, several other states, including Arkansas, Indiana, Louisiana, Mississippi, Montana, North Carolina, Utah, and Virginia, have also enacted similar laws requiring age verification for users of online pornographic content.
